Mandeville, LA – Exclusive Transcript – “Chris Ferrara: Protestant critics of the founding documents weren’t saying the documents were evil in themselves.  They were saying: Yes, you’ve got a great technical form of government here, but the document doesn’t recite any fundamental principles that would guide its interpretation.  It doesn’t invoke divine law as other constitutions have done, either in terms of custom or of documents.  At the nation’s founding, there was some invocation of God, some appeal to higher principles.  What these Protestants were saying in the 19th century was our constitution doesn’t do this.  What is left out, they said — this is mid-19th century — will one day be declared un-American.  Now it’s considered un-American to say that Christian moral principles should govern laws and institutions.  Since the U.S. Constitution is now applied to the states via the Incorporation Doctrine under the Gitlow decision, effectively every state constitution must conform itself to the U.S. Constitution.

Mike:  Back to the Dude Maker Hotline and Chris Ferrara, author of Liberty, the God That Failed.  The conversation we were having when the gremlins pulled the plug on us, you were right in the middle of explaining the missing element in today’s America or today’s United States and how the average citizen has become a willing participant now and seemingly an imprisoned participant in a closed system, that is they wish to practice — even if they want to practice, as you point out in the book — look, you can have your Constitution.  You can have republican forms of government, provided that they are run by people that acknowledge that there is an authority that is higher than them, and that is the only thing that will prevent liberty, the god, failing as it is today.  I’ll let you run with that.

Christopher Ferrara:  That’s obviously the case.  The Catholic Church, of which I am a member, has never condemned democracy, per se, nor has it called for monarchy, per se.  The issue is not the form of government.  This has been thematic in the discussions we’ve had on your show.  The issue is not one of form but one of substance.  This republic of ours, we’re governed by the higher law.  If it were allowed to be governed by the higher law, it would be a very different picture that we’d be looking at right now.  You’re right.  As I said earlier before the gremlins yanked the show — I’m not a conspiracy buff, by the way, but coincidence?  I don’t think so.  As we were saying before we went off the air momentarily, if you play by the enemy’s rules, on the enemy’s playing field, you’re going to lose every time.  If you consent to be, at the level of the public and the social, effectively a kind of liberal, then it’s a debate between liberals and liberals.  When liberals debate liberals, guess who wins?  The liberals.

Mike:  Here’s a recent example.  We’re all guided by the fact that we have constitutions and we want to have a written constitution.  Okay, fine.  The people of Virginia, where you live, Chris, have a written constitution.  It doesn’t matter.  A federal judge has just said even if your written constitution is in effect and it’s yours and you ratified it and you ratified an amendment to prohibit same-sex marriages being legally recognized in your state, because there is no moral authority under which that same-sex marriage is either approved or denied, then it’s all up to the magistrate.  It’s all up to who says what liberty says ought to happen, right?

Ferrara:  Yeah.  What happened with the Fourth Circuit decision is this.  You got the first part of it.  The Fourth Circuit says: You might have your nice little Virginia Constitution.  You might have your local law ban on same-sex marriages.  That’s all well and good, but there’s a higher constitution, the United States Constitution.  There’s nothing about the definition of marriage or divine or natural law in the United States Constitution.  The United States Constitution, as we interpret it, requires strict religious neutrality on these questions.  Liberty has to be understood to embrace all these personal choices that people make. Ferrara:  Yeah.  Now we have another problem coming down the pike.  If the states are going to be prevented from defining marriage in accordance with Christian moral principles, then what’s going to happen with the Supreme Court’s decision of upholding gay marriage in New York on the theory that the states have the right to define marriage as they see fit?  As Scalia said in his dissent from that decision: The Supreme Court says today that the states are free to define it any way they please.  They can define it traditionally or non-traditionally.  That’s just the other shoe waiting to drop.
