Next year should be a banner year for the GOP, and may yet be.

Obamacare, a “train wreck” about to happen, says Democratic Sen. Max Baucus, goes into full effect Jan. 1, with the popular IRS as enforcer.

The Obama media feel betrayed by the secret intrusions on First Amendment rights. Libertarians see the National Security Agency’s data mining as a massive violation of Fourth Amendment rights.

The White House is bedeviled by scandals, the second-term curse has caught up with the Obama presidency, and prospects for the U.S. economy seem dicier than a few months ago.

History is also on the GOP’s side. In the second midterm elections, Presidents Wilson, FDR, Eisenhower, JFK-LBJ, Nixon-Ford, Reagan and Bush II all suffered big losses. It has become a tradition.

But if the GOP is favored to hold the House and make gains in the Senate, the long-term prognosis for the party remains grim.

First, libertarianism is breaking up that old gang of mine. Sens. John McCain and Lindsey Graham call for air strikes on Syria. But no echo is heard, as the Republican Party becomes anti-interventionist...

Mike:  I know a lot of Republicans, buttloads of them.  I cannot say with certitude other than the ones that I would not really call Republicans but would call Libertarians, that they have become anti-interventionist.  The American exceptionalism and the Jacobin-based patriotism that these people ooze, live, sleep, eat, and breathe, to me, is still very rabid, very front and center and hasn’t gone anywhere.  It may have fallen out of favor and those that practice it and espouse it may not want to blabber about it today, but I don’t think it’s been overcome with anti-interventionism or noninterventionism.  I think that there are more noninterventionists and there is some libertarian -- I wouldn’t even call it libertarian.  I think that’s a mistake to call it libertarian.  I think there’s more [r]epublican, like the logo that I created to hopefully accentuate the use of the term and its proper connotation, not capitalized.  I think there are more republicans being baptized and immersed in republican -- it’s not ideology because you don’t want to be an ideologue -- in republican tradition and pragmatism than ever before, or ever in my lifetime anyway...

Mike:  The reason that you congregate together in May of 1787 and break your convention in September of 1787 and then go back to the states to try to ratify this thing called the Constitution, the reason this was done is so that the states would have an agent that would act on their behalf.  It would act on their behalf -- I was actually reading this last night in Max Farrand’s records of the Federal Convention.  I actually read the entire report on the Committee of Detail.  The Committee of Detail was charged with taking all the ideas of the Federal Convention of 1787 and jotting them down into a form that could create a document like the Articles of Confederation that they would ultimately call the Constitution.  The Committee of Detail was charged with distilling the ideas and putting them all together, eschewing the ones that were not going to pass, concisely writing the ones that were going to be passed.

I also stumbled upon, as I was reading this last night, a wonderful passage from, I want to say it was James Wilson but there aren’t a lot of annotations on who wrote what.  I think it was Wilson who was the delegate from Pennsylvania.  Wilson said: Look, what we’ve got to do here is, not only do we have to write these ideas down and put them in some kind of order and divide them into clauses, we have to make this so that the average American person in 1787 could read it and understand it.  Let me repeat that.  The average person in 1787 that was literate could read it and understand it.  The Constitution and its language had to be so clear that it would not be confusing.

They knew they had a battle coming to try and get the thing ratified.  They knew that that was not going to be easy.  The only way they could possibly hope to achieve it and thus consummate the work of the summer of 1787 was to place the case in the Constitution itself in a manner so clear that anyone that read it would understand it.  Of course, even after those efforts, that’s not the way it happened, as we know from the acrimonious debate in Virginia over ratifying and how the Virginians, led by George Mason who was a the convention, and Patrick Henry who was not but was at the ratifying convention, of how they vigorously opposed ratifying, and we know why today.

Mike:  Then it goes through and lists the qualifications for the electors.  Article I, Section 2, Clause 1:

The House of Representatives shall be composed of Members chosen every second Year by the People of the several States, [Mike: This is what is in question here.] and the Electors in each State shall have the Qualifications requisite for Electors of the most numerous Branch of the State Legislature.

Mike:  For example, in the State of Louisiana, if there are more representatives than there are senators -- assuming that every state has a bicameral legislature, representation on one side, Senate on the other, making that assumption, and that’s what they’re assuming, that there will be bicameral assemblies in every state -- whichever branch has the most members, whether it’s the Senate or the representatives of that state, however the state determines in their constitution what qualifications the electors, meaning the voters, will have to cast a ballot, then that is the same identical qualification that you would then have to cast a ballot for a member of the House of Representatives or for the Senate or for the presidency, as has been amended by the 14^th, 17^th, 24^th, and 26^th Amendments...

This Day In Founding Fathers History – 18 June 2013

On this day in 1775, Abigail Adams wrote to her husband John Adams about the Battle of Bunker Hill. “The Day; perhaps the decisive Day is come on which the fate of America depends…Charlestown is laid in ashes. The Battle began upon our intrenchments upon Bunkers Hill, a Saturday morning about 3 oclock & has not ceased yet & tis now 3 o’clock Sabbeth afternoon…how many have fallen we know not-the constant roar of the cannon is so distressing that we can not Eat Drink or Sleep.” ₁

In 1775 on this day, George Washington wrote to his wife Martha about his reservations with commanding the Continental Army. “…so far from seeking this appointment I have used every endeavour in my power to avoid it, not only from my unwillingness to part with you and the Family, but from a consciousness of its being a trust too far great for my Capacity.” He also talks about having had a will drawn up and having paid the majority of his debts. ₂

On this day in 1812, the War of 1812 began with President James Madison’s signing of a declaration of war against Great Britain. The United States was frustrated with Britain’s maritime practices of interfering with American trade. Thousands of American lives were lost in the war, which lasted over two years. From this war came the Star Spangled Banner and the burning of the White House. It ended with the signing of the Treaty of Ghent in Belgium on Christmas Eve 1814. ₃

It takes on added weight now that the Washington Post and the Guardian have reported that the National Security Agency's Prism program, in the days before Obama was sworn in, tapped into Google's servers . . .

Mike:  Our Project ’76 webisodes -- this one is not a webisode yet but it will be.  It’s under the headline “Jimmy Madison Didn’t Do Congressional Charity Work.”  Kevin Gutzman sent this to me, Dunlap and Claypoole’s American Daily Advertiser of January 14, 1794.  It is a discussion between Madison -- this is in Congress -- and a congressman Smith “On the Memorial of the Relief Committee of Baltimore.”  I thought you would find this interesting, Andrew.  This was a committee that was formed in the City of Baltimore for the St. Domingo refugees.  There were seven points that Madison made.  What apparently Congressman Smith wanted to do was an appropriation.  He wanted to fund relief efforts for these refugees.  James Madison said: Excuse me?  Under what authority do you find that in our Constitution?  Then he gave a stirring address that was recorded in the Congressional Globe and then printed in the Daily Advertiser of Dunlap and Claypoole’s.

“It is hardly possible to do justice to the affecting narrative of Mr. Smith—suffice to say, that a greater scene of misery and distress was hardly ever before witnessed, nor a more noble and prompt display of the finest feelings of the human heart exhibited than in the relief afforded by the citizens of Baltimore.” James Madison opposes this as not within constitutional purview:

“Mr. Madison remarked that he presumed no arguments, no efforts of oratory were necessary to excite emotions of benevolence in the mind of any member the house towards those unfortunate fugitives [from Saint-Domingue].  He had no doubt that the feelings of every man were alive to a sympathy for their situation, but he remarked that the government, confined to specified objects—it is not like the state governments whose powers are more general.  Charity is no part of the legislative duty of the government; it would puzzle him to lay his finger on any part of the constitution which would authorize the government to interpose in this business; the report of the committee he observed involved this constitutional question.”

Mike:  Hello, Mark, how you doing?

Caller Mark:  On this gathering, the data gathering, I have two points.  First is that apart from the constitutionality or legality -- I’m not going down that road -- I’m just saying apart from that, I think the doing of it forever alters a culture, what it is for us to be Americans or live in this country is forever altered by the fact that -- literally to where (I’m going to be a little bit gross) you walk in a room, an empty room in a hotel and wonder whether you can pick your nose or not, or ought to.  That’s the first thing.  That’s the significant point.  That one really, really frosts me.

Secondly, I would love to, and I think it would be possible to do it, but I would love to do a complete audit, without necessarily disclosing who, what, where, but by a trusted person or persons where they would audit and let the NSA or whatever show them every situation where we found out specifically X.  And having found that out, we did specifically Y.  And had we not done specifically Y, Z would have happened.  Then juxtapose those events into the actual terrorist events we’ve had since 9/11 or whatever, or before 9/11 if you want, since there’s been gathering.  I dare say that there would be -- I don’t buy it that this data gathering is resulting in that activity which is preventing that result.  I don’t buy a nickel of it.  Those are my two points and I’m sticking with them.

Mike:  I think those are good points.  I think the earlier discussion that we had today and all of last week and a majority part of the week before, and the case that Senator Paul is arguing and members of the House of Representin’, some wise souls are arguing that what is transpiring is happening under the watchful eye of the Congress that apparently has extended a general grant for the execution of this power.  This is why it is such a big concern, and it ought to be a concern.  A general grant is a horrendously dangerous thing.  Of course, if you have a general grant, that means you can sit there: I think I’m able to do this.  Let’s just give it a go and see.  Instead of a specific, specified grant that would say: Look, there’s X group.  This is who we think is their leadership.  Congress is actually targeting this group by name and we’re serving notice that we’re talking to them...

Mandeville, LA - Exclusive Video and Audio - On Thursday Jerrold Nadler reported that he learned that the NSA does actually listen to phone calls without getting a warrant, they just have to get the approval of an analyst.  Well, on Friday Nadlers handlers get word of the story and issue a statement clarifying that that isn't what Nadler said. According to them Nadler didn't learn who they COULD spy on, he learned who the NSA COULDN'T SPY on and they would have to get a warrant. Well, even if this is partially correct, there has already been a general warrant issued, so the NSA already can spy on people. So Nadler was already right when he was wrong. Mike:  If you’re trying to keep up with this, basically what you have here is a conflict -- this all stems from a Western-led effort to get a gas pipeline to pass from Qatar through Syria, then up north through Syria it makes its way to Europe.  If that happens, then the Russians who currently control most of the European natural gas market, or sell most of the natural gas that Europeans use, they’ll have actual competition.  This is why the Russians are involved.  It’s not because they love Assad; it’s because they love selling natural gas.  So you throw us in the mix.  [mocking] “Hey, Paulie, Rocko, we need to get a cut in this.  Where’s our stake?  Where’s our patronage?”  So of course we can’t sit on the sidelines and just let the Russians do this sort of thing.  We have to get involved and claim it’s in our interest, although I haven’t heard anyone demonstrate why it’s in our interest.

This Day In Founding Fathers History – 14 June 2013

On this day in 1776, Congress ordered General Schuyler to hold a conference with the Six Nations – Mohawk, Oneida, Tuscarora, Onondaga, Cayuga and Seneca Indians – to “engage them in our interest upon the best terms that can be procured” as well as to prepare to take post and erect a fortification at Fort Stanwix. ₁

In 1775 on this day, Congress resolved that six companies of expert riflemen be raised in Pennsylvania, Maryland and Virginia, and that each company march to Boston and join the army presently there. The present-day U.S. Army celebrates this day as the anniversary of the Army’s establishment with the Continental Army. ₂

On this day in 1777, Congress approved the design of a flag. “…the flag of the thirteen United States be thirteen stripes, alternate red and white: that the union be thirteen stars, white in a blue field, representing a new constellation.” Since that time there have been 27 different versions of the U.S. flag. On 14 June 1885, Bernard Cigrand, a teacher, had his students observe the day as Flag Birthday. Thereafter Cigrand was a proponent of establishing a national day of observance to the flag. A few years later, another teacher celebrated the day with his children and the State Board of Education in New York adopted the day as Flag Day. Various individuals and groups started to observe the day as well, including the Betsy Ross House, New York Society of the Sons of the Revolution, Pennsylvania Society of Colonial Dames of America, and Secretary of the Interior Franklin K. Lane. In 1916, President Wilson officially established Flag Day, but it was not a national holiday until 1949 when President Truman signed an act of Congress establishing 14 June each year as National Flag Day. Court cases have been heard regarding whether or not one must be compelled to salute the U.S. flag. In 1940 the Supreme Court decided the government had the authority to compel respect for the flag as a symbol of national unity; however, in 1943, the Supreme Court reconsidered their previous decision and stated the First Amendment guarantees free speech and denies the federal government the authority to compel any individual to salute the flag or recite the pledge of allegiance. ₃

Mike:  History is filled with episodes where intelligence has won and lost wars.  No one things, myself included -- I am not of the opinion that intelligence is not useful, that intelligence is not beneficial.  No one is arguing whether it is or not.  I’m sorry, for all you neocons and decepticons out there, there is no justification for the apparatus the size of the state that we currently have.  If there is a justification for it, and the hundreds of billions of dollars, and the hundreds of thousands if not millions of people that must be employed in order to work it, then I would say whatever we have done that has angered so much of the planet that we need that large of an army of computer geeks in order to protect us from all these cyber things that are going on and might result in practical and real-world calamities, then we are beyond out of scale.  Our out of scale has things that are out of scale, the proportion of it is so large.

Hear the story of the United States AFTER the Constitution like you've never heard it before

Let’s just do a thought exercise here on this show, since we have the time to do it and no other show does.  Let’s just say, for example -- let’s just play a “what if” game.  What if, as a result of this, the American sheeple came to their senses, and either under threat of forming new federations and seceding in order to do so demanded the elimination of the Central Intelligence Agency, the National Security Agency, the National Intelligence Survey, Department of Homeland Insecurity, the Transportation Security Administration, dismantle the entire thing, phase them out.  You’ve got three years to get rid of all these agencies.  You are allowed the commanders of each of the individual branches of our rapidly paring down standing army are allowed to have, within reason, intelligence services at their disposal.  These people are not civilian; they are military; they are specifically executing what it is they do on a military, threat-assessed basis, which is how it would have been done in bygone eras.  That is now the national defense apparatus.

This means the recalling of the Air Force, the recalling of the Navy, the recalling of all the troops that are stationed all around the known universe.  This means an end to the military-industrial complex and all the things that go along with it.  This means that the United States is withdrawing from its pernicious influence and its insistence that we get to run the world and call the shots all around the known globe.  All we then do is act peacefully, trade with other nations.  If anyone threatens us, we raise a little larger of an army, display a show of force, we internally improve our defenses to where we are impregnable on our coasts and over our skies.  That’s about the extent of it.  We’re not worried about what happens anywhere else on the globe and whether or not we can influence it or change it or mold it so that it meets our approbation.  We are simply peacefully coexisting in the League of Nations.  In other words, we’re taking the Monroe Doctrine stance.  If you don’t take a stick and prod us or try to invade and become hostile in our hemisphere, we’re not going to mess with you.  All we want is amity and trade and felicity with the rest of the nations of the world...

Mike:  I told her that I was reading a letter that James Madison wrote to Thomas Jefferson about the Alien and Sedition Acts in May of 1798.  In his letter, Madison obliquely refers -- he’s very oblique.  He does not provide any detail whatsoever.  He tells Jefferson: If Adams and his buddies proceed with this Alien and Sedition Act tyranny -- this all has something to do with the NSA surveillance and the evisceration of the Fourth Amendment and the abuses that are going on under the Obama administration and were started principally by the Bush administration, but let’s be honest, they’ve been going on since the end of World War II.  When I told her that I stumbled onto this reference, Madison says something to the effect that there has been a meeting in the Town of Fredericksburg.  It was so animated that if that’s an indication of what the response to the Alien and Sedition Acts are going to be, then we have much work to do, but we’ll have many people to do it with.  It doesn’t provide any details of what this meeting was other than it happened in Fredericksburg and it happened in May of 1798.

I thought to myself: Self, can you find out anything about this meeting?  Because I am an über Google searcher -- I’ve read the manual on how to search for things.  There are tricks to using Google searches that if you know how to apply them, if anything has ever been written on any particular subject, and if it’s on any server anywhere, you can find it.  That’s actually kind of scary but it is true.  You just have to know how to search for it.  I began looking for this meeting.  It did take me half an hour.  After about half an hour, there I was reading an excerpt from the Virginia Herald newspaper dispatch of 15 May 1798.  I have been unable to locate an actual scanned copy of the original print of the Virginia Herald, but what I was able to find was someone that had transcribed it back at that time and this made its way into another book.  I found the meeting.  The good news for you is the meeting has been discovered.  It happened on Monday, May 14, 1798.  It happened in the courthouse in Fredericksburg, Virginia.

This is so cool.  This is what I find amazing about this.  Thomas Jefferson leaks -- they would have called Jefferson a leaker.  Jefferson is vice president.  He’s not supposed to be telling anyone what his boss John Adams has up his sleeve.  So Jefferson leaks out that he believes there will be an act to deal with sedition and an act to deal with alien friends that are going to be forthcoming from the Adams administration.  The good citizens of Fredericksburg, Virginia get ahold of this.  There were two groups.  There is one group that are the advocates of the president.  They call themselves Friends of the Adams administration.  Then there’s the other group of the rabble rousers, you and me.  This would be us back in 1798.

They get wind that they’re going to have this coronation of the Alien and Sedition Acts, which haven’t even been passed yet, in honor of President Adams at the Fredericksburg Courthouse.  To nip it in the bud, they canvass the entire town to oppose the action.  In opposing the action, they go to the courthouse and vote down this resolution commending President Adams, by a vast majority.  Here is how the Virginia Herald recorded the event of Monday, May 14, 1798.  You can read this for yourself and it will become a Project ’76 webisode.  You can listen to it, put it on your phone or iPod or computer and take it with you...

Mike:  Check that, Ms. Daum, everyone on the planet.  I watched the interview last night.  I watched it again.  Snowden said they had the ability to spy on the planet.  This is not limited to the United States.  We have the ability to eavesdrop on everyone on Earth.  We have the ability to shut down computer systems, entire electrical grids almost anywhere on the planet.  Oh, great.  That’s what part of being the greatest nation in the history of the Earth is, the ability to shut power off to anyone that hiccups in the middle of the night that Peter King is afraid of.

This Day In Founding Fathers History – 13 June 2013

On this day in 1866, Congress passed the 14^th Amendment to the U.S. Constitution. It was ratified by 28 of the 37 states and went into effect just over two years later. ₁

In 1816 on this day, an announcement appeared in Baltimore newspapers, “Gas Light Without Oil, Tallow, Wick or Smoke.” It was a sensational headline for the time, but was followed by a description of the new gas lighting on display at the Peale Museum. An admission fee was charged for the public to enter and observe the innovative lighting. The Peale Museum was the first public building in the United States to use gas lighting. Rembrandt Peale installed the lights for the publicity they would garner, and he gained the attention of several investors. He purchased the patent for coal gas manufacturing of Dr. Kugler and organized the charter for the Gas Light Company of Baltimore. ₂

On this day in 1775, the Massachusetts Provincial Congress was notified that a New Hampshire citizen visiting Boston had overheard British commanders William Howe, John Burgoyne and Henry Clinton planning their capture of Dorchester and Charlestown. Their plan was to take the Dorchester Neck, fortify Dorchester Heights, and then take the colonial forces stationed in Roxbury. Then Charlestown would be taken and the forces in Cambridge repelled. On June 17, the Battle of Bunker Hill was fought. ₃

These things are incompatible, ladies and gentlemen.  Those of you that hold this schizophrenic point of view need to go bang your heads against the wall or go back and read some Jefferson and Madison and Taylor of Caroline.  If you don’t want to do that, go back a little further.  Go read some David Hume, Idea of a Perfect Commonwealth.  If you don’t want to do that, maybe go back and read some St. Thomas Aquinas and really get your head screwed on right.  You can’t have and demand of a government that oversees 310 million, you can’t ask it to do that and then be surprised when it has to erect such a gargantuan state in order to execute the mighty task that you have given it, then protest mightily against it when it seeks to discharge the duty that you have charged it with.

This is where I think part of the disconnect is.  Your average American sherson out there, the ones saying: I don’t much mind if they eavesdrop on me.  I don’t have anything to hide, so if they’re just listening to my calls, if they’re just cataloging where I am and taking the metadata, I don’t really have an issue or problem with that.  That’s not a big deal.  All they’re getting is metadata.  As I pointed out earlier in the program today, if you gather enough metadata, you can put a pretty accurate picture together of what someone is, who they fraternize with, and where they fraternize.  This is not hard to do...

According to the department's letter to the judge, the Food and Drug Administration has told the maker of the pills to submit a new drug application with proposed labeling that would permit it to be sold "without a prescription and without age or point-of-sale prescriptions." [Mike: So can nine-year-olds buy it? Mike:  Donald is in Taxachusetts next on The Mike Church Show.  Hello, Donald.

Caller Donald:  Good morning, Mike.  I’ve got a question for you.  I don’t know if you guys saw it in the articles about Snowden, but he said that the NSA had the ability to even spy on the President of the United States.  I guarantee you that if they had the ability to do it, you know they probably monitored some calls, looked through his emails.  Obama has to know that now.  I just don’t understand why he’s not even upset about that.  Where I work, if I spied on my boss, I’d probably lose my job, if I went through his emails and stuff.  My question is, who do these people, who do these agencies really work for?  All this transcends over administration.  Who are they really working for?  Is the president really in charge of anything or is he just a public relations man that’s backed by a whole bunch of interest groups?  That’s what I wonder sometimes.

Mike:  Well, the companies that make the spying equipment, the people that are in the employ and the unions to which they belong.  The fact that there is a super-secret surveillance state means that there are going to be consequences to that.  There are going to be military consequences to that.  People that make military hardware that have to arm the soldiers and ships and arm and make the planes, they all benefit from the spyfare state.  As a matter of fact, there are a couple columns at the American Conservative Magazine website that deal with this.  Patrick J. Buchanan asks “Who Can Check the Surveillance State?”  He wonders, if we’re stuck with a surveillance state, and it seems that we are, then what is there to do about it?  Here’s what he says in part:

That the IRS conspired to use their legal powers to surpress political speech and violate the First Amendment. Looking back on the post-founding era we can find lots of "Beer Beer inspiration" to draw a response from.  Of course Americans of 2103 will have to actually want to respond to the NSA spies outside of signing a Ted Cruz petition or attending a Tea Party rally & cheering Sara Palin. The following is how in May, 1798, the citizens of Fredericksburg VA reacted to the news that Congress was, according to Thomas Jefferson, following the neoCON - neoJACOBINS of their day and ginning up a war with France.

"Parker is completely gone over to the war party. In this state of things they will carry what they please. One of the war party, in a fit of unguarded passion, declared some time ago they would pass a citizen bill, an alien bill, & a sedition bill; accordingly, some days ago, Coit laid a motion on the table of the H of R for modifying the citizen law. Their threats point at Gallatin, & it is believed they will endeavor to reach him by this bill. Yesterday mr. Hillhouse laid on the table of the Senate a motion for giving power to send away suspected aliens. This is understood to be meant for Volney & Collot. But it will not stop there when it gets into a course of execution. There is now only wanting, to accomplish the whole declaration before mentioned, a sedition bill, which we shall certainly soon see proposed. The object of that, is the suppression of the whig presses. Bache’s has been particularly named. That paper & also Cary’s totter for want of subscriptions. We should really exert ourselves to procure them, for if these papers fall, [r]epublicanism will be entirely brow beaten."(5)

The freemen of Fredericksburg, hearing Jefferson's alarm, sprang into action as recorded in "The Virginia Herald." (3)

On Monday the citizens of this corporation met, agreeably to notification published in the public papers, to express their sentiments on the present important and critical situation of this country. The meeting was called by the friends of the Executive, whose object was to address the President of the United States and to express their entire approbation of his conduct with respect to our foreign relations. "An address to this effect was prepared and presented by Thomas E. Bootes, Esq., which he supported by very lengthy arguments. He was followed by Capt. John Mercer, Col. John Minor and Col. John F. Mercer, who successfully combatted the various arguments adduced by Mr. Bootes in support of his address. And the following resolutions then, prepared by Dr. David C. Ker, were approved and adopted. A division was called for on the address and resolutions and tellers appointed to take the number of votes, who reported that two-thirds of the citizens present were in favor of the  resolutions. The meeting was more numerous than any we have ever seen in this place. During the whole of the discussion the most perfect order and decorum prevailed. The resolutions, adopted in place of the address, will be interesting reading to our people, even in this day. They are as follows:

2nd. 3rd. Resolved, That the instructions to our envoys, so contrary to the spirit of that speech and the whole conduct of our administration, authorize this conclusion : — that they were rather intended
to inflame the American mind than to produce good in France, under the well grounded expectation, that the negotiations would, from those and other causes, fail.

4th. Resolved, That the late negotiations with unauthorized swindlers in Paris, are so unexampled as to afford no justifiable ground for public measures, and that their publication, so far as they tend to excite the sensibility of our citizens, is unjustifiable, as they may commit the safety of the envoys highly imprudent.

5th. Resolved, That the militia are the only safe and constitutional defence of these States ; that they alone are adequate to this object, and that they will ever prove so, if guided by good government. 

6th. Resolved, That we hold it to be our bounden duty, and we do solemnly pledge ourselves, firmly, to support our National rights and independence whenever assailed by foreign invasion or domestic usurpation.

Fontaine Maury was chairman of this large gathering of the people and signed the resolutions adopted by the meeting. They were then sent to Hon. John Dawson, representative in Congress from this district, who laid them before the extra session of Congress for the consideration of that body. These resolutions, adopted on the 14th of May, 1798, setting forth the principles upon which their authors believed the Union was founded, and upon which the government should be administered, were the basis for the famous resolutions drawn by Mr. Madison and passed by the Virginia Legislature on the 2nd of December of the same year, which have since been the theme of Virginia Statesmen of that school when they would "revert to first principles."(4) - S.J. Today's "conservatives" would be wise to re-discover those [r]epublican "first principles the men of Fredericksburg lived by. Note that this meeting's impact was felt by Jefferson, Madison et al as they prepared the VA Resolutions on Nullification, knowing the sentiments of the Old Dominion's citizens were in their favor.

This Day In Founding Fathers History – 12 June 2013

On this day in 1775, the Battle of Machias was fought, the first naval battle of the Revolutionary War. British authorities had enlisted Loyalist Ichabod Jones to acquire needed supplies. Two of Jones’ ships, Unity and Polly, were escorted to Machias by the British Margaretta, an armed sloop. The citizens of Machias did not trust Jones’ business practices so they decided to arrest him and go after the Margaretta. James Moore, commander of the Margaretta, managed to escape but the townspeople, led by Jeremiah O’Brien, outfitted one of Jones’ ships and pursued him. In the battle, Moore was fatally wounded and his vessel and crew were captured.  ₁

In 1775 on this day, British General Thomas Gage, governor of Massachusetts, issued a proclamation in an effort to offer amnesty to those who would lay down their arms. Amnesty was not extended to Samuel Adams or John Hancock, however, as they were believed to be the leaders of the Massachusetts rebellion. Gage also, in his proclamation, declared martial law on the province of Massachusetts. The proclamation had an overall condescending tone and gave the citizens of Massachusetts an ultimatum: either you’re with Britain or you’re against her. ₂

On this day in 1776, the Virginia Convention unanimously adopted the Virginia Declaration of Rights, authored by George Mason. The Declaration of Rights was influential in the drafting of both the Declaration of Independence and the Bill of Rights. The Declaration of Rights was incorporated into the Virginia State Constitution as Article I. Although Mason was the primary author, James Madison, Patrick Henry, Thomas Ludwell Lee, and Edmund Pendleton influenced the final declaration. ₃

Mike:  Let’s go to the Dude Maker Hotline and say hi to Professor Dr. Kevin Gutzman and get his constitutional take on all this, if there is one.  Kevin, good morning, how are you?

Kevin Gutzman:  Hello, Mike, how are you?

Mike:  I am well.  Do you buy, are you purchasing cloth sewn by the president when it comes to what he knows about the NSA surveillance program and its harmless nature?

Gutzman:  Well, of course, Mike, there are two issues here.  Number one is whether the program as he’s described it is objectionable; and number two is whether we trust him.  I guess I’ll start with number two.  No, I don’t trust him.  I don’t trust people in government generally.  I don’t think we can assume they’re only going to use the information they say they’re trying to get.  That is, once they have the capacity for monitoring our emails, voicemails, phone messages, text messages and so on, in terms of who’s sending them and who’s receiving them, I don’t think we can be sanguine in the expectation that they’re not actually going to look at the content.  That does worry me, it’s been worrying me.

You and I have previously discussed the fact that Congress, at the very end of the Bush administration, adopted legislation exemption the telecommunications corporations like Verizon from civil responsibility from having divulged secret information to the government while Bush was president.  Similar things have been going on for years.  You and I have both objected to the fact that tens of millions of Americans apparently were affected by the Bush-era behavior of the federal government.  Congress said those people are never going to know who they were or which communications the government was privy to.  To me, that’s problematic ever since I learned about it then.

Gutzman:  Right.  The other thing is whether we want the federal government to be somehow monitoring telecommunications because we’re worried that people in Pakistan or Afghanistan, Iraq, Saudi Arabia, Egypt, Syria and so on are conspiring to blow up more skyscrapers and more airplanes.  My answer is yes, I do want the federal government to be keeping tabs on those communications in some way.  I think that’s always going to be problematic because we’re always going to be suspicious of people in the executive branch.  I think the current administration, like the previous one, has given use every reason to think we can’t trust them, that they don’t respect our historic rights, that they think nothing of the idea of unlimited government.  This is, after all, the president who appointed a justice to the Supreme Court who found it literally laughable that there was any limit of the power of Congress to tell us to eat three helpings of broccoli every day.  I think these people have no idea of limited government, so of course I’m worried that they are going to be mining everything I say or every image I send or every text I write and so on...

Mike:  We did learn over the weekend that Edward Snowden, a young man who was working for a contractor that was executing the tyranny against the American people, that Snowden is the whistleblower.  Last I checked last night, he was holed up in a hotel room somewhere in Hong Kong and was hoping that someone would extend political asylum to him.  AG, do you have any news?  Is Snowden still in China as far as we know?

AG:  He has left the hotel but no one seems to have a beat on the location in terms of where he’s at now.

Hear the story of the United States AFTER the Constitution like you've never heard it before

Mike:  So he fled the hotel.

AG:  Yes, or checked out.  I don’t know if fled has a negative connotation, but he checked out of the hotel.

Mike:  Why would you need to check out?  Let me get my phone bill.  I need my room charges.  I may file for a reimbursement from my employer.  Snowden was featured in a video that I guess he taped and aired on the BBC.  I know the Guardian had it on their website.  Snowden is a 29-year-old.  According to a profile of him written at CNN, he had contributed to the campaign of Congressman Paul.  That reminds me, when Paul was running for president -- I had highlighted that particular part of the story and made a note to remind myself.  Does this now mean -- Bradley Manning has been praised by Ron Paul and I believe had a similar relationship to Paul, meaning he donated to his campaign.  Now we have Edward Snowden having donated to the 2012 presidential campaign of Ron Paul.

Mike:  We go back to the 19-teens, in the period known as World War I.  You will find a great quote from the great H.L. Mencken, a satirist and author without equal in his time.  He had a collection of essays that went under the title of A Book of Burlesques.  If you know what the term burlesque means, it’s already funny.  Mencken’s A Book of Burlesques, you will find this little gem, and it’s often misquoted.  I myself have paraphrased it.  This is the actual quote, and I think this bears heavily on our current state of affairs.  Just so you don’t get your hopes dashed that the slumbering American giant has now awakened.  [mocking] “Maybe this’ll be the thing that wakes America.  You need to wake up, American people.  Wake up!”  Let me assure you, they are still slumbering mightily.  They are sawing logs the size of sequoia redwoods out there over this.  This is a big snooze fest for those that are not politically active and motivated.  Your average American sherson does not car what his or her government is doing to them right now.  They have no interest in it whatsoever as long as, as I said, they can keep social media and Starbucks coffee.

Here’s what Mencken said under the headline of “The Jazz Webster.”  He takes a bunch of words and he redefines them to fit life in 1916, about the time Woodrow Wilson was conning the American sheeple into entering World War I.  This is one of the things that Mencken was protesting mightily against.  Here’s the jazz version of Webster’s definition of democracy: “The theory that two thieves will steal less than one, and three less than two, and four less than three, and so on ad infinitum; the theory that the common people know what they want, and deserve to get it good and hard.”  So they know what they want, the average American sherson out there, and it’s more than what we have here today apparently.  It is disconcerting.

Here are the results from the polls: “Fully 45 percent of all Americans say the government should be able to go further than it is.”  What, does the government need to monitor the contents of what we’re flushing down the toilet now, American sheeple?  How much further is further?  Do each of us need to have assigned a guardian spook, a guardian spy to watch and micromanage and catalog every last thing that we do, lest we stray from the government’s guidelines when it comes to nutrition, who we ought to be calling and when we ought to be calling, where we ought to be driving and how we ought to be driving and what we ought to be driving in?  This is really troubling...

Mike: I thought I'd start off here today by giving the State of the Dude Nation address. Now, we're in the time that is in between the end of school many of your children are getting out of school, or they'll be out of school here soon; mine have been out for two weeks now and enjoying their summer holiday, thank you very much, and then the actual beginning of summer. And of course we have Independence Day coming up. And even if you're not going to take a vacation and leave town I can't afford the gas, Mr. Church many of you still are taking a vacation.

And so there's a lot going on here that has nothing to do with the issues of the day. There's a lot going on that has nothing to do with trying to repair the damage, or at least stopping more damage from being done on a daily basis here. And I think, now, we talked about this. There was an absolute doldrum. It was noticeable. It was palpable. You could taste it. You could feel it. In late December, all through the month of January, through most of February, most of you people admit it to yourselves dropped out. You went back to watching Pirates of the Caribbean. You went back to not caring about what was going on in the world around you. You went back to doing whatever it was you were doing before you became enlightened, before you became concerned, before you became this and that and the other, because you thought the NDC that's the New Deck Chair Party running the House of Representin. Well, I did my job, Mike. I elected Boehner. Now shut up. Lets get to talking about Pirates of the Caribbean.

Mike Church Show Transcript: Rand Paul Can Live With $2.6 Trillion Worth Of Government, And That's A Good Thing

And then when it became apparent that the New Deck Chair Party wasn't a New Deck Chair Party, it was just a reincarnation of the Old Deck Chair Party, and it was doing exactly what was predicted, or that we predicted that it would do, there was no shock, no surprise here. There still isn't shock and surprise. Some of you got reengaged here. Now, I don't think that the, as Alexander Hamilton said in my other movie, The Spirit of 76, I don't think the vox populi, I don't think the vox populi is reengaged just yet. And Ill tell you why. I believe and AG, did you find that Washington Post poll for me? You did. Okay, thank you. This is interesting. I don't like living my life by polls, and I don't like doing this show based on what public opinion polls say. I do think its interesting from time to time to visit them and just to see, try and get a little bit of a snapshot of what people are thinking out there.

I think really, seriously, I think many people are despondent, hopeless, heartless, have given up, don't see any reason to continue because you put all your efforts, you put all your eggs into that basket that said Elect Republicans in 2010, you joined the Tea Party, you remonstrated, you protested, you made signs, you sent emails, you signed petitions, you called, you harangued, you harassed, everything that you thought or that ostensibly people of good conscience should do to stop evil in your midst. And you weren't able to stop it. And I bet you many of you still think that it is a futile activity and that its an activity that's not worthy of your time.

As a matter of fact, I'm probably talking to a lot less people because, even though we try to keep the emphasis on E for entertainment here, because people don't think its worthy of their time. You're just a number. You're just a sheeple. You haven't made a difference. You cant make a difference. They've won. Lets just sit back and enjoy the ride. Lets just sit back and forget about those stupid idiot Founding Fathers. We cant get back to them. We cant reincarnate them. We cant reinstitute the liberty, legacy, limited government that they left us. Everything we've tried has failed miserably. Everything that we have done has failed miserably. And so whats the point, Mr. Church?

I'm telling you, I can feel you people out there. I can look at the traffic on Facebook, on Twitter; I can look at the traffic on websites; I can look at the opinion polls. I can look at other peoples websites and look at the exact same thing. And I can tell. A reasoned individual would draw this conclusion. And I think that that is a misguided and ill-conceived conclusion here. Maybe this is what Barry and the Obamanauts want you to think. Maybe this is what the DeceptiCon establishment wants you to think, that there is no hope, that there is really nothing. We tried and tried, and we weren't able to accomplish it. But the fact of the matter is that you have. Wonderful things have actually transpired over the course of the last two years that were totally unexpected, wholly unpredicted, and still today many people don't believe that they have happened.

And one of the things that has happened here, that has transpired and this wasn't hard to predict here if you actually study market economics and if you study the way that empires, the course of history of how empires have imploded and of how the end has come about. This was actually a pretty easy call. And one of the things, and well talk to I'm going to ask Congressman Paul this question today. This is one of my questions that I'd like to know is, in the face, in the midst of one of the biggest public humiliations in political history, this 76-year-old man named Ron Paul refused to take no for an answer, never wavered from his message, never wavered from the Constitution or the Founders, never wavered from his duty, always kept a smile, was always upbeat, always positive, which is really hard to do. How did he do that? What inspires man or woman to be like that, to do that?

I think that's a great story. I don't think people are telling that story. People, oh, yeah, Ron Paul this, Ron Paul that. What about what Ron Paul had to endure to even get to where he is today, to where for the first time public opinion polls show him in double digits? For the first time, when pitted against other candidates, hes in the top three, top four, sometimes top two, where for the first time there's no Giuliani going [whooping], heckling him. And there's no one laughing about his positions. And few are laughing about the predictions that he made because they're not funny now because they're coming true. And he tried to warn you. What inspired that gentleman to think like that, to do that? I think that's something we can all learn from here today.

And that's the bright spot. Many people are rejecting status quo. They're rejecting the Democrat/Dumbocrat establishment. They're rejecting the DeceptiCon establishment. And they're coming to the realization that neither political party has an answer, that political parties are the problem, which is why we reacted with such force and such zeal against what that lady from the Tea Party Express said, Ms. Kremer said the other day. And I think that is a development that is similar to what the Founders would have called their Committees of Correspondence or the attitudes that they saw inside their Committees of Correspondence. Keep that in mind. Remember, if you've seen my movie, and there's about 700 of you out there now who have were going to get to 100,000, whether you people like it or not. 100,000 people are going to watch this film. They're going to love it, fall in love with the story of the Founders. And you're going to see that the Founding Fathers were big-time underdogs. They were not going to get independence in 1774, 1775, or in the beginning of 1776.

So my point in starting the program off with this here today is, I know it seems like its tough. I get depressed, too. Lord knows you've probably heard me talking about being not the happiest, most positive person in the world. But there's a saying out there, its an old saying by, I believe its Solzhenitsyn that said this no, it wasn't Solzhenitsyn. Who said this, AG? Maybe you can find this. If something cant go on forever, then it will end. And this will end. As my cousin Patrick is fond of telling me, this, too, shall pass. And it will pass. And when it does pass, there's going to be a better tomorrow. That's what you're fighting for. That's why you don't give up. And that's why you stay engaged. These people are losing their grip. The establishment is losing. They are on the run. They're the ones that are fighting to hold the territory that they stole from our parents and that they stole from our grandparents. Well, dammit, you cant have it. Were coming to take it back. AG, do you have that clip from Rand Paul, from when he won the primary in Kentucky? Do you remember what he said that night, the first thing that he said to that audience? I have a message from the Tea Party. Were here to take our government back. Do you remember that?

Mike: Even if you cant pull it up, I can quote it, what Rand Paul said the night that he won the primary. Not the election, the primary. I have a message from the Tea Party. We've come to take our government back. Well, folks, the Federal Reserve and their ilk are on the run. They're on the defensive. The corporatist hacks are on the defensive. The military-industrial complex is on the defensive. Federal agencies and departments, they know they're hated. They know they're scorned. They know they don't have the support of the people that they purport to govern. And they know that there's a very vocal, very opposed, very committed minority that is not going to take these TSA searches, this confiscation of our properties and our raw milk and our elderberries. Were not going to let you do this any longer. Your days are numbered, sir, ma'am, madam.

These are positive developments. These things would not be possible under status quo. I mean, look at it this way. Had John McCain actually beaten Obama and had status quo Republicanism, which would have made this far worse than it is, or as worse as it is, but militarily speaking far worse, had McCain won, it probably would have made the word conservative a four-letter word because those sinister hacks out there in the fringe media would have attached McCain to all of us. It would have tried to make all of us in bed, agreeing with John McCain. And that's not the way it happened. I think things happen for a reason. Take the great gifts that we've been given, the opportunity the opportunity, as painful as it is right now of watching what these Keynesian, what these corrupt, what these inherently doomed and destined-to-fail people and their ideas and their hackneyed old thoughts that have been proven the world over that they don't work, and all they do is create misery and mayhem, they are in the last throes of enjoying their power. New day of liberty is upon us here, ladies and gentlemen, a new day. Its right around the corner. And you must stay engaged, you must stay positive, and you must keep the pressure on.

And I don't mean just keeping the pressure on Boehner and Company. I'm talking about keeping the pressure on your mayor, your neighbors, your grandma, your mother, your uncle, your Aunt Bertie, whoever. Keep the pressure on. Keep doing exactly what it is that has gotten us to here today. And on your behalf I will ask Congressman Paul for a little bit of inspiration there in that regard because Lord knows, if anyone has seen what it looks like from the bottom of the barrel, looking at the escape hatch at the top, it has to be Congressman Ron Paul. The reason why this animates me and sets me off is because this idea, this idea is at the heart of the cancer. That guy that called me last hour is evidence of the left’s success. The guy that said, “Eh, Kennedy says that ask not what you can do for your — what your government can do for you, what you can do for your government. And the only reason I’m able to drive this truck around the country is because of our government and how wonderful it is, this and that and the other.” That guy had it exactly backwards, that the government created prosperity, it did no such thing; that the government created freedom, it did no such thing; that the government created opportunity, it did and does no such thing. It infringes on opportunity. It infringes on freedom. It is there specifically for — or it is there to execute specific purposes, specific initiatives. It has specific objectives, that it was agreed in Philadelphia in 1787.

And, if you must know, and you should, before there was a Constitution, there were people. They considered themselves, when they weren’t being ordered about by another government run by a monarch, King George III and his various precedents, King James and what have you, those people considered themselves to be reasonably free. They are the ones that estab- in other words, the free people, the good people, as Thomas Jefferson said at the end of the Declaration of Independence, by and on behalf of the good people of this country do declare that these united colonies are, and of right ought to be, free and independent states, by and on behalf of the good people. Those good people established the Constitution. They wrote it. Those men were representatives of the people. They created the government to secure their liberties. It says it in the Preamble. That’s the reason for it.

So the Constitution didn’t bring forth any rights. It did not create any rights. Didn’t call forth from heaven rights. They were already there. They already existed. It is there to ensure the blessings of liberty, to see to it that government cannot encroach on the liberty that made the creation of the Constitution possible, folks. I just — I marvel at this, at the completeness with which the left has executed its exorcism of liberty from these shores and its exorcism of individuals and individualism from these shores. That it has brain-dead, mind-numb, bot zombie robots out there regurgitating the state line. “Oh, the government gives us things. The government gives us that. The government does....”

As I said, as I said, we created that beast. It is our beast. It is supposed to be responsive to us. Not the other way around. And it just, man, it pains me to, I mean, that stuff is right out of the Communist Manifesto. It is right out of Marxist writing and what the Germans believe. Notice I said “believe,” not “believed.” They believe it. It’s right out of what the ChiComs believe. This is a dangerous way of thinking. Either you’re going to be a free people, and you’re going to govern yourselves, and you’re going to fight and defend vigilantly your liberty; or you will have a state that will arbitrarily decide what liberty you may use and what liberty they have taken from you because you’re not smart enough to exercise it. Or, “It’s too dangerous to be in the hands of the people, like owning guns. That’s a dangerous liberty.” You must guard against this. This is what our founders knew.

Mike: Let me read to you how a Founding Father accepted his inauguration. This will come as a shock to you people, but I actually have here in my hands the text of Thomas Jefferson’s first inaugural address. Yes, even back then those old fuddy-duddy guys in white stockings and powdered wigs gave addresses when they were inaugurated. The striking thing about Jefferson’s inauguration is the humility and the humble attitude that he approached it as. Which you’ll hear here in the text when I get into it.

Now, I want to just let you know that this – I have already posted, or have already compiled today’s Surf Report of today’s Pile of Prep. Did you people do your show prep today? Did you? You can do your show prep after the program, and prep your own little show here. I have already posted the links to the Avalon Project where you can go and download or go read Jefferson’s entire inaugural address. I’m not going to read the whole thing because we don’t have time. So I’m just going to read the pertinent parts here. But here’s what you’re listening for. Number one, the humility of the whole thing. And Jefferson going out of his way to say, I am not a king, and I don’t want to be. We have rejected kings. Listen up, you people. This is also a refutation of John Adams.

By the by, that reminds me. There was a time in American history when presidents didn’t hang around for the next inaugural, when they didn’t go on national television or the equivalent thereof and wish their successor the greatest success in the world, when they didn’t dawdle over what had just transpired. As a matter of fact, John Adams is famously known to have left town at 3:00 a.m. the morning of Jefferson’s inaugural. They portrayed this in the HBO miniseries “John Adams.” They showed Adams getting on the stagecoach and getting the hell out of Dodge. He left. He didn’t want anything to do with it. And Jefferson didn’t want him to have anything to do with it. After the passage of the Alien and Sedition Acts, and after all the transgressions that the Adams administration had visited upon the people in violation, in clear violation of what Federalists said the new federal government would do, and there were Federalists doing exactly the opposite of what they had said that they would do. So it was good riddance to get rid of John Adams and kick him, basically embarrass him into leaving Washington without telling anyone goodbye, and certainly without hanging around to wish Jefferson well. He just didn’t do it. You know why, because the transfer of power there was a ceremonial thing. We were not transferring one king to another here. Well, let me get to Jefferson’s inaugural address, March the 4th, 1801. The words of the man that authored, principally authored the Declaration of Independence, Thomas Jefferson.

“Called upon to undertake the duties of the first executive office of our country, I avail myself of the presence of that portion of my fellow citizens which is here assembled to express my grateful thanks for the favor with which they have been pleased to look toward me, to declare a sincere consciousness that the task is above my talents, and that I approach it with those anxious and awful presentiments which the greatness of the charge and the weakness of my powers so justly inspire.”

Did you hear that? Did you catch that? The weakness of his powers? [Blustery voice] This is a pres- what do you mean, the weakness? Why, they tell everybody what to do. Well, they didn’t used to. You really want to talk about a constitutional presidency, well, here is one.

“A rising nation, spread over a wide and fruitful land, traversing all the seas with the rich productions of their industry, engaged in commerce with nations who feel power and forget right, advancing rapidly to destinies beyond the reach of mortal eye – when I contemplate these transcendent objects, and see the honor, the happiness, and the hopes of this beloved country committed to the issue, and the auspices of this day, I shrink from the contemplation, and humble myself before the magnitude of the undertaking. Utterly, indeed, should I despair did not the presence of many whom I here see remind me that in the other high authorities provided by our Constitution I shall find resources of wisdom, of virtue, and of zeal on which to rely under all difficulties.”

In other words, what he’s saying there is, if I have any problem executing this office, I can always yank out my handy-dandy C-SPAN Constitution and read it. Did you catch that part? Jefferson may actually have read Article II, Section 2 of the Constitution. This is shocking, here, folks. And no, I don’t think Bush read it, either.

“To you, then, gentlemen, who are charged with the sovereign functions of legislation, and to those associated with you, I look with encouragement for that guidance and support which may enable us to steer with safety the vessel in which we are all embarked amidst the conflicting elements of a troubled world.”

Wait a minute, now. I thought this was a world of trouble unlike any ever encountered in the history of man. Have you noticed the pimping up of the dire situation that we’re all in here today? Why, only someone of Obama’s magnitude can come in here and save us all from ourselves, and save us all from international destitution and international despotism. It’s bad. It’s never been this bad. This is the worst economy since Plato. This is the worst economy since Ramses I. No one’s ever seen economic conditions like this before. Raise the bar here. Because if Obama makes any progress or has any success whatsoever, why, this is proof that he’s the Messiah and what have you. Now, you listened the words of Jefferson here as he humbly accepts the office. What a striking contrast, ladies and gentlemen. All right. Now, I’m reading to you the inaugural address of Thomas Jefferson, 4 March 1801. Back to the text.

“We have called by different names brethren of the same principle. We are all Republicans. We are all Federalists. If there be any among us who would wish to dissolve this Union or to change its republican form, then let them stand undisturbed as monuments of the safety with which error of opinion may be tolerated where reason is left free to combat it. I know, indeed, that some honest men fear that a republican government can not be strong, that this Government is not strong enough; but would the honest patriot, in the full tide of successful experiment, abandon a government which has so far kept us free and firm on the theoretic and visionary fear that this Government, the world’s best hope, may by possibility want energy to preserve itself? I trust not. I believe this, on the contrary, the strongest Government on earth.”

Now, can you wrap your hands, your heads around this at this time? 1801. None of the things that you know to exist as federal government today existed, they hadn’t even concocted yet. No one had even dreamed of these things. And yet there’s Jefferson with the meager, limited constitutional government of the United States in 1801, saying this is the strongest government on earth. You have no idea what you created, sir.

“I believe it the only one where every man, at the call of the law, would fly to the standard of the law, and would meet invasions of the public order as his own personal concern. Sometimes it is said that man can not be trusted with the government of himself. Can he, then, be trusted with the government of others? Or have we found angels in the forms of kings to govern him? Let history answer this question.

“Let us, then, with courage and confidence pursue our own Federal and Republican principles, our attachment to union and representative government. Kindly separated by nature and a wide ocean from the exterminating havoc of one quarter of the globe; too high-minded to endure the degradations of the others; possessing a chosen country, with room enough for our descendants to the thousandth and thousandth generation; entertaining a due sense of our equal right to the use of our own faculties, to the acquisitions of our own industry, to honor and confidence from our fellow citizens, resulting not from birth, but from our actions and their sense of them.....”

That’s a repudiation there of the idea of monarchy, by the way, aristocracy. “Resulting not from birth” means you have actually earned it.

“...enlightened by a benign religion, professed, indeed, and practiced in various forms, yet all of them inculcating honesty, truth, temperance, gratitude, and the love of man; acknowledging and adoring an overruling Providence, which by all its dispensations proves that it delights in the happiness of man here and his greater happiness hereafter. With all these blessings, what more is necessary to make us a happy and a prosperous people? Still...another, shall leave them otherwise free to regulate their own pursuits of industry and improvement, and shall not take from the mouth of labor the bread it has earned. This is the sum of good government, and this is necessary to close the circle of our felicities.”

Mike Church Show Transcript: Mike Tells The Story Of June 1788 and The First Peaceful Transfer of Power

Now, listen to this. He just said I’m not going to tax anything that has anything to do with labor. Because it’s your earnings. How refreshing that would be in 2009, would it not, ladies and gentlemen. Back to Thomas Jefferson. Perhaps you’ve heard of him. His inaugural address, 4 March 1801. This is the meat-and-taters portion. This is where he lays out what an actual constitutional government would look like and what his view of it was.

“About to enter, fellow citizens, on the exercise of duties which comprehend everything dear and valuable to you, it is proper you should understand what I deem the essential principles of our Government, and consequently those which ought to shape its Administration. I will compress them within the narrowest compass they will bear, stating the general principle, but not all its limitations. Equal and exact justice to all men, of whatever state or persuasion, religious or political; peace, commerce, and honest friendship with all nations, entangling alliances with none...”

Can you imagine that? Entangling alliances with none? Back to Jefferson.

“...the support of the State governments in all their rights, as the most competent administrations for our domestic concerns and the surest bulwarks against anti-republican tendencies; the preservation of the General Government in its whole constitutional vigor, as the sheet anchor of our peace at home and safety abroad; a jealous care of the right of election by the people – a mild and safe corrective of abuses which are lopped by the sword of revolution where peaceable remedies are unprovided; absolute acquiescence in the decisions of the majority, the vital principle of republics, from which is no appeal but to force, the vital principle and immediate parent of despotism; a well disciplined militia, our best reliance in peace and for the first moments of war, till regulars may relieve them...”

Can you imagine that? Did you catch that part? He’s saying here, at this time in 1801, that Hamilton’s army must be disbanded. Alexander Hamilton had rallied an army, called it constitutional, used it to collect taxes in the Whiskey Rebellion and what have you, was ready to march on those that were not accepting of the Adams administration’s decrees. And here’s Jefferson saying, eh-eh. We only need a militia. We’re not at war, sir. And if we do go to war, we’ll then raise an army. Meanwhile, the Minutemen out there with their muskets and what have you, they can do the first line of defense. They’re perfectly capable of it. Boy, this just blows holes throughout the entire Second Amendment debate, does it not? All you idiots out there that think that you know something about the right to keep and bear arms, and oh, no, the Founding Fathers didn’t mean it to be an individual right, they didn’t mean it like that, no, that’s been misinterpreted. Well, then read this inaugural and tell me that I’m wrong. Back to Thomas Jefferson, his inaugural address, 1801. He’s talking about the well-disciplined militia.

Mike Church Show Transcript: Despite What The History Books Say, John Quincy Adams WAS A Founding Father

“...our best reliance in peace and for the first moments of war, till regulars may relieve them; the supremacy of the civil over the military authority...”

There it is again.

“...economy in the public expense, that labor may be lightly burthened; the honest payment of our debts and sacred preservation of the public faith...”

In other words, balanced budgets.

“...encouragement of agriculture, and of commerce as its handmaid; the diffusion of information and arraignment of all abuses at the bar of the public reason; freedom of religion; freedom of the press, and freedom of person under the protection of the habeas corpus, and trial by juries impartially selected. These principles form the bright constellation which has gone before us and guided our steps through an age of revolution and reformation. The wisdom of our sages and blood of our heroes have been devoted to their attainment. They should be the creed of our political faith, the text of civic instruction, the touchstone by which to try the services of those we trust; and should we wander from them in moments of error or of alarm, let us hasten to retrace our steps and to regain the road which alone leads to peace, liberty, and safety.

“Relying, then, on the patronage of your good will, I advance with obedience to the work, ready to retire from it whenever you become sensible how much better choice it is in your power to make. And may that Infinite Power which rules the destinies of the universe lead our councils to what is best, and give them a favorable issue for your peace and prosperity.”

This Day In Founding Fathers History – 10 June 2013

On this day in 1752, Ben Franklin conducted an experiment which has grown into legend. As with so much of history, it happened a bit differently than we’re told. Franklin hypothesized that lightning was a form of electricity. His method of proving this was originally church steeple but he then opted to go fly a kite. It was a handmade kite consisting of a large silk handkerchief and two cross-sticks, as well as a metal key tied to the kite’s string. Franklin and his son William (then age 21, not a young child as illustrations often portray) proceeded into a field with a nearby shed for protection. The two had to wait “a considerable time” before the kite was electrified. Franklin “observed some loose threads of the hempen string to stand erect, and to avoid one another, just as if they had been suspended on a common conductor.” He then touched his knuckle to the key and received confirmation of its electric quality. ₁

One notable birthday on this day in 1735, that of John Morgan. Morgan was a pioneer of medical education in the U.S., co-founding the first medical school in the country at the College of Philadelphia, now University of Pennsylvania. In 1775, Congress appointed Morgan the director-general of the army’s hospital in Boston. Morgan’s job as director of the army hospital was an immense task. He faced an outbreak of smallpox, shortage of supplies, logistical challenges, and a Congress that lacked the understanding of health issues necessary to support him fully in his role. Morgan’s former partner turned rival, William Shippen, helped to point the blame squarely on Morgan and have him unseated as director. However, Morgan had the last word, as he convinced Congress to formally charge Shippen with fraud and speculation in hospital supplies, for which Shippen was court-martialed and subsequently resigned. By this time Morgan was in poor health and did not return to medicine. ₂

I would approach this from the standpoint and the point of view: What necessitated the original sin?  Where was the original sin committed?  The original sin was committed when the United States got so big, bad, and powerful that it began to entertain the wet dream fantasies of the elites that run things in this country who believe they actually could be James Bond villains and they could rule the world.  That’s right, a bunch of utopians that believe if the United States of America was only forceful enough, we’re going to shroud and cloak all this in our love for our fellow man, our love for mankind, our admiration and respect for all of humanity.  All of mankind must live and experience life and freedom the way people in the United States of America have.  That’s the original sin, the hubris and arrogance of being an American, believing that we have some God-given right to dictate to the rest of the known universe how, when, where they will live, under what government they will operate under, what natural resources they will have access to and who they may sell them to, where they may sell them, how they may transport them.  [mocking] “That government’s not amenable to the kind of natural resources we need to pilfer from your country, pal, so we’re going to install our own little shah there, Mr. Mosaddegh.”

We have lost every aspect of our life because of the government, because we are so afraid to stand up on our own two feet and shout to the government on the hill and tell them what we think.  We’re so afraid that they’re going to get into our phones and our personal lives.  So what?  They already know everything we’re doing.  That’s why they run the government.  That’s why they are in government, because they already know.  For them to dig into more shit, fine.  Get on my phone, get in my pictures, see my checks, see that at 15 years old I was smoking pot behind an alleyway.  Go ahead, find that information out and please come after me and talk to me about my wrongs and my rights.  In the end, when I stand up and tell you face to face as a human being on this earth you are no different than I am and you are no better than I am, so who are you as the government, in my country that my ancestors founded, who are you to tell me what I can and cannot do?  Who are you to tell me what I can and cannot pay?  How are you going to dictate and judge and rule my life in this world as a human being, not as an American citizen, not as an African-American, not as an Eastern, not as a Chinese, not as anybody who breathes and bleeds the same goddamned way that I do?

Mike:  I enjoyed your last bit on Bill Maher.  I couldn’t tell because I wasn’t there, but it appeared as though you took Maher a little bit by surprise by telling him: You know, Bill, if we weren’t going around the world and doing all the things we’re doing, maybe people wouldn’t be so angry at us.  You posted a column yesterday about this barbaric murder on the streets of London and how it’s being classified as an act of terror.  In your column you said: Wait a minute, if that’s an act of terror, what is it that the United States and UK do around the world?  What do you call that?  Illuminate the audience on your last piece, please.

Glenn Greenwald:  Sure.  Whenever there’s an attempted attack or a successful attack on the United States or Western countries that are allies, like Britain, as happened in Boston a few weeks ago and then two days ago in London, there’s this immediate sense of not just outrage, which is understandable, because when you see violence, it’s natural to be outraged, but also kind of shocked and surprised and bewilderment, like how can anybody be so monstrous as to do something like this?  There’s even a kind of subtext to it that’s been going on for more than a decade, which is why would anybody possibly want to come to the United States or the streets of London and kill people?

Mike Church Show Transcript: Gotta Have More War - Senate Approves Arming Syrian Rebels

It’s a really important question to ask and the answer is almost always obscured.  The answer that’s usually given is these are people who hate us for our freedoms or they’re Islamic extremists.  The reality is that there are huge numbers of countries around the world that are entirely free -- Brazil, Japan, South Africa, Peru, Sweden -- where no attacks ever take place.  The question is why do they want to attack the United States as much as they do or countries like the UK?  All you have to do to answer that is listen to what virtually every person who perpetrates violence against the United States and the UK says, which is: We are doing this because you spent decades killing innocent Muslim children and women and men, dominating our countries, occupying and invading and bombing us, propping up our dictators, and we feel this is necessary not just to avenge on that aggression but to get you to stop doing it.  We need to ask ourselves what role we play in the kind of violence that we like to denounce when we’re the targets but not so much when we perpetrate it.

Mike:  Did you ever think that your political alliances, particularly in foreign policy, would come from so many different factions that would not traditionally be thought of as like minded on anything, like libertarians want to legalize marijuana, the anti-war left, those on the right like Pat Buchanan that has a similar view on foreign policy?  The view towards foreign policy is really forming some strange new alliances, don’t you think?

Greenwald:  I do.  I’ve been writing about the possibility and my hope for this kind of trans-partisan, trans-ideological alliance on these issues for as long as I’ve been writing about politics.  In my first book in 2006 when I denounced the Bush administration’s executive power abuses, spying on us without warrants in secret, torture, and the like.  I devoted a whole chapter to people on the right who were not just as vocal but often more vocal than Democrats in denouncing these things, people like the Cato Institute who were very early critics of Bush foreign policy and civil liberties abuses were I’ve spoken several times, columnists like George Will and former Reagan administration officials.  Then, amazingly, the first person ever to go on the floor of the Senate and talk about the evils of President Obama’s drone program and the threats it poses to liberties, the way in which it’s killed innocent Americans and people around the world was Rand Paul.

Mike Church Show Transcript: You Wanted War And You Got It...For Decades To Come

I do think you see this alliance.  It goes back a while.  The ACLU joined with the Christian Coalition against the Patriot Act and other measures that were designed to deprive Americans of their liberties.  It sort of lurks under the surface.  The problem is that the government and the two political parties are very good at concocting ways to keep these factions that should be joined together at each other’s throat over cultural issues, symbolic issues, and the like, and that prevents these kinds of alliances.  I think more and more you see them coming.

Mike:  You used to write at Salon.com.  Many folks may say: If he’s a writer at Salon, that means he’s a lefty.  He’s probably a big fan of President Obama.  I’ve read almost all of your work from about 2010 onward.  I’ve gotten the distinct impression that you’re not a fan of President Obama.  Is he a big disappointment to you?

Greenwald:  Disappointment implies that I had high expectations and that he’s fallen short.  I think you saw the kind of politician he was even back in 2008 when he was seeking the Democratic nomination.  He vowed that he would filibuster any bill that gave retroactive immunity to the telecom for the role they played in the illegal Bush spying program.  He got the nomination and as soon as he got it, he turned around and not only didn’t filibuster that bill but voted in favor of a massive expansion of surveillance powers.  I think expectations with him are pretty low, but I do think that even those of us that were pretty cynical about him from the start have been surprised at just how aggressively he’s embraced and even expanded many of the Bush-Cheney programs in foreign policy and civil liberties that, as senator and candidate he pretended to oppose.

Mike:  Glenn Greenwald from Guardian UK newspaper is on the Dude Maker Hotline with us.  A follow-up question on that.  You mentioned the 2008 campaign.  As we looked at 2012 and the Republican side of it, we had some minor movement, with Ron Paul being present, and for a while it appeared that John Huntsman might actually be a noninterventionist.  Now looking at 2016, heaven forfend we should start talking about this already, do you think that the move towards nonintervention, does it have the kind of momentum that I hope for, and I think you hope for, as we move forward?

Greenwald:  Absolutely.  For one thing, I don’t think the full significance of what Ron Paul achieved in 2012 has been even remotely realized.  He went into the reddest of red districts in the country, to Iowa and South Carolina and New Hampshire, and very boldly spoke about American foreign policy and the aggression it’s unleashed and the cost we pay financially, militarily and in terms of risk to our security.  Really that message, although in 2008 it got demonized by demagogues like Rudy Giuliani, in 2012 it really found an audience.  There were other reasons why he appealed to as many people as he did, but he didn’t hide those views.   He really featured them centrally.  I really have always believed that once Americans start to fully realize the costs that they incur from this vast, sprawling, what Dwight Eisenhower warned as the military-industrial complex, in terms of billions of dollars going to Israel and Egypt in order to protect Israel, massive military bases all around the world, sustaining this massive, permanent army that increases the power of the federal government, as they start to lose their Social Security and Medicare benefits and ask where that money is going instead and realizing it’s going to all this military adventurism, I absolutely think that kind of economic anxiety will finally reel in this sprawling leviathan.

Mike Church Show Transcript: Unauthorized, Undeclared Wars Go Back Much Farther Than Obama Or Bush

Mike:  You write for Guardian UK.  You had written the other day that Spencer Ackerman, who I believe is one of the editors or senior writers of Wired Magazine is going to be joining you very soon there as well.  The Guardian is worldwide.  We can read it here in the United States, but it is based in London.  Do you think that international opinion is now turning against the kind of bellicose foreign policy that certainly the Bush administration practiced and the 2009 Nobel Peace Prize winner has done little to stop that?

Greenwald:  I think that’s unclear.  Interestingly, the Guardian, what I technically write for is the U.S. edition.  They have an office of about 50 people now in New York because the U.S. media has been so miserable when it comes to covering issues of U.S. militarism and imperialism.  The Guardian has developed a huge American audience on its own.  That’s why they came into the U.S.  There’s this fascinating report from the CIA in 2008 that worries about growing antiwar sentiment in Europe.  It said the way to stop this is to elect Barack Obama because it would replace the face of George Bush, which had alienated so many people, with this prettier, constitutional, progressive face of Barack Obama as the face of America’s wars and would make these wars more popular.  I think to a large extent that did happen, but even in western Europe and elsewhere, there’s a growing sense that this permanent war is just unsustainable beyond the fact that it’s morally grotesque.

Mike:  You say permanent war.  Last week, we heard high-ranking officials in the Obama administration testify that they can see the “war on terror” dragging on for another 10 to 20 years.  John McCain is famous for having said in 2008 he thought we would be in Iraq for 100 years.  Based on what you heard President Obama say yesterday at the National Defense University, do you think that the perpetual and never-ending war is now with us perpetually, to never end?

Greenwald:  I do, at least for as long as it can be sustained financially and politically.  President Obama did say some pretty words yesterday and some nice things about the dangers of endless war and the way it destroys liberty, quoting James Madison.  He sort of said ultimately at some point we may have to stop this war.  One thing we’ve learned is that his pretty speeches bear almost no relationship to his actions, except that they indicate what he’s not likely to do.  I think the bigger issue is this sprawling national security state composed of massive corporations and political agencies and officials who benefit greatly from this endless war, both financially and in terms of power.  They are very vested in having it never end.  They wield a lot of power.  Until there is some competing force demanding its end, which can really only come from the citizens, it’s impossible to see why or how it would.

Mike:  When the president also yesterday talked about the use of drones, and I was talking about this earlier today, that the danger with this is that this sterilizes warfare.  You have people sitting in nondescript buildings thousands of miles from where the action is and they’re moving pixels on a screen.  They have no weapons in their hand, per se, or in actuality, but they have the power to unleash a weapon.  To use the drone as the weapon of choice now, or it seems that President Obama has used the drone as the weapon of choice, are we dangerously entering a time in which our actions have become now so mechanized and computerized that even the killing of other human beings doesn’t have the impact, and won’t that make never-ending war even greater of a possibility?

Greenwald:  That’s a great question.  I think drones make never-ending war more likely for two reasons.  One is what you just said.  It’s always been the case that the U.S. government and the media have purposely hid the identities or number of people that we kill in other countries because they don’t want the American public to have to face, in a visceral way, how many lives we’re simply extinguishing.  That’s a key thing for sustaining popular support of the war, to let people block out the fact that we’re continuously slaughtering people.  Drone do that even more because it removes us even further from the results of our violence and, as you say, makes it more clinical and mechanized.

The other reason is that one major deterrent to war for countries always has been the fact that when they fight wars, they put themselves at risk.  If you go to war, you can be killed, shot down, attacked.  What drones enable the United States to do is to kill people from very far away, safe distances.  You remove that cost of war that has always been an impediment, which is the fact that you yourself can be killed as you engage in the violence, and makes it almost risk-free, or at least much less riskier.  That, too, I think makes the willingness of political leaders to engage in violence much higher.  Of course, there is the danger, and I don’t see why it won’t happen, that drones will start to be used by U.S. domestic police forces, not necessarily huge predator drones with hellfire missiles but small handheld ones.  Once you get the population to accept the framework that drones should and can be used to kill bad guys, why would it be confined to foreign nationals?  It’ll also be used to kill bad guys on domestic soil as well.  I think that poses all sorts of other dangers.

Mike:  Onto what I talked about earlier in the program, since I have the stage all to myself, which is fine by me.  June the 7^th, 1776, what happened?  What happened?  Maybe June the 7^th, 2013 can imitate and replicate and be inspired by June 7, 1776.  I will read to you what happened from the congressional record.  This is from the journals of the Continental Congress.  It’s in today’s Pile of Prep.  Instead of emailing the latest Obama birth certificate or IRS outrage, please save your pixels.  Why not email an actual event in American history that maybe could inspire enough people to do as Colvin earlier said, and as the last caller said: When are the people going to wake up?  Maybe when they learn a little bit more about their history and what some people thought their birthright as Englishmen was, I would say, since many of us are descendants of our glorious forefathers of Great Britain who gave the term liberty its first real extended, and I would say still functioning, experiment.

That’s what Richard Henry Lee brought to the Continental Congress in 1776.  It wasn’t the idea to form a more perfect union.  I’m going to call BS on anyone that says that.  It was to defend the ancient rights of British America and of British-Americans, that they had the right to govern themselves and they had the right to tax themselves.  They had the right to declare their own wars and fight their own wars.  They had the right to regulate their own commerce.  They had the right to conclude peace with other nations without having to go through the parliament of Great Britain because they were free and independent.  Richard Henry Lee strode to the floor of the Second Continental Congress early in the morning of 7 June 1776, a Friday morning just like this one is.  Here’s how the record recorded it:

Mike:  Recapping the big news of the day, it has been reported by the Guardian newspaper that Verizon Wireless was ordered, in April, to surrender all phone records of all 121 million customers to the National Security Agency under the Patriot Act, a judge signed off on.  This is a massive, massive subpoena, basically, and it was made under the aegis of the Patriot Act.  But we were told by decepticons and neocons and frauds that call themselves conservatives, who I guess stopped being simple libertarians a long time ago: Nothing to worry about in the Patriot Act, man.  You guys need to lighten up.  You libertarian nuts, you need to calm down.  Besides, what do you have to fear?  If you haven’t done anything wrong, so what they turned your records over to the government?  Big deal!  Big deal?

AG:  What do you think about Al Gore tweeting out how outraged he is at the Verizon scoop?  I would also make the assumption that Sprint and AT&T are in the deal as well, it just hasn’t been released yet.  When we talked to Glenn Greenwald a couple weeks ago, you asked him the question about different groups of political ideology that you wouldn’t associate being together on issues like nonintervention coming together, the Pat Buchanans, the libertarian marijuana/drug crowd, the left-wing anti-war crowd.  Are we going to start to see a similar kind of amalgamation of groups on issues like the IRS, like these phone taps, that sort of thing, where you’d see an Al Gore agreeing with a guy like Rand Paul in situations where you wouldn’t expect that previously?

Mike:  Wait a minute, that’s not possible.  I was just watching Christine Romans on the Clinton News Network this morning regaling me with all the wonders of the new housing boom.  If you’re following the housing boom and you’re out there looking at your house like it’s an ATM machine again, [mocking] “Please let the prices go up.  I really want that 98-inch TV they have at Sam’s, but I can’t afford it unless I can use my house as an ATM machine.  Please, God, let the home prices go up!”  If you are of this persuasion, you may want to know, there is a commodity exchange for lumber.  You can follow the bulk price of lumber.  If there really is a housing boom, then the price of lumber would be up.

Mike Church Show Transcript: Rand Paul Can Live With $2.6 Trillion Worth Of Government, And That's A Good Thing

I checked the lumber commodity index last Thursday.  The peak was back in the latter part of 2012 and the early part of 2013.  There is no longer a boom in lumber.  If there’s no boom in lumber, if lumber prices are on the way down, that should suggest then that your vaunted and hallowed, newly-inflated, irresponsible housing bubble is already deflated.  That’s a good thing, especially if you don’t own a home and you wish to buy one.  If you’re one of these people that views your house as an automatic teller machine, a vehicle that you use to take cash out of whenever you need it to go buy that third ski lodge in Aspen or the second Tesla sports car, not such good news.  Back to the recession story:

The latest ISM reading came in at 49. Any reading below 50 is considered recessionary. And an ISM of 49 is the worst in four years.

The Fed, as usual, is oblivious to this. Bernanke claims we’re going to see a 3% GDP growth in 2014. We haven’t seen annual GDP growth of 3% since Bernanke took office. And he and the Fed have been claiming that a recovery was just around the corner for five years now… that’s HALF a business cycle...

Caller Mike:  Maybe you could petition for a new timeslot.  Number three in my morning routine is checking on Drudge for my daily dose of right-wing news.  The headline on Drudge was that the Department of Homeland Security has been monitoring all Verizon phone traffic, which I’m a Verizon customer and stockholder.  This is my morning hour.  We’re turning into the Soviet Union.

Mike:  I didn’t see the headline, so forgive me.  Why are they monitoring Verizon’s traffic?  What are they looking for?

It requires Verizon, one of the nation's largest telecommunications companies, on an "ongoing, daily basis," to give the NSA information on all landline and mobile telephone calls of Verizon Business in its systems, both within the U.S. and between the U.S. and other countries...

Mike:  I want to know, under what surveillance act, how in dude’s holy name does the National Security Agency, from whence do they deign to find the authority to eavesdrop on millions?  You can’t possibly make the case that all those warrants -- it would seem to me it would require a warrant to get this.  In other words, Mike, if they wanted your records, fine.  “Why do you want his phone records?” -- “Well, we think he’s having chat conversations, doing face time with Ayman al-Zawahiri.” -- “All right, fine.  I’ll grant the order, but you actually have to look and see if he’s with Ayman al-Zawahiri.  If he’s not, I’m going to rescind the order.”  That’s one individual.  I can understand that.  Law enforcement, security, I can understand that.  To say that we want millions of records, that is an evisceration of civil liberties that is not to stand.  That cannot stand.

Caller Mike:  Mike, I have an answer to your question how they can do that, because I actually called Verizon this morning before I called you.

Mike:  Is it in the fine print that you didn’t read when you signed up for your phone?

Caller Mike:  No, they told me the Patriot Act.

Mike:  I said Constitution, not act of Congress.  I wasn’t talking about the 535 miscreants.  I was not speaking of those that continually, on a daily basis, violate every concept and every interpretation of what an oath means and what an oath of office to a Constitution means.  So they can just subpoena or demand all the records?

Mike:  Do you remember the 10-year-old girl who is trying to get a lung, little Sarah Murnaghan?  The evil lord of the Department of Health and Inhuman Disservices, that is the highest-ranking abortionist in the United States hierarchy, Kathleen Sebelius, informed the Murnaghan family: No, you can’t get a lung transplant, your tyke is ten.  You have to be at least 12 to get a lung transplant or get on the list for the adult lungs available.  If a juvenile lung becomes available, you’re already on the list.  The Murnaghans took their case to court.  A federal judge yesterday ordered that the Murnaghan girl be placed on the list for the lung should one become available.  You can find the story at FoxNews.com.

Judge Michael Baylson made his ruling after hearing oral arguments Wednesday afternoon on a federal lawsuit filed by Sarah's parents, challenging the "Under 12 Rule" that was keeping the 10-year-old off the adult transplant list.

Baylson’s order tells Department of Health and Human Services Secretary Kathleen Sebelius to direct the group that manages the organ transplant list to cease application of it in Sarah’s case.

An event happened yesterday.  Martin Bashir, who is a third-rate host on a third-rate network, that’s MSNBC, attempted his own version of what I will call a Touré.  AG, do you remember back in probably June or so last year, August when this young man Touré -- what is that show that S.E. Cupp is on?

AG:  The Cycle.  I think it’s The Cycle, right?

Mike:  Yes, The Cycle.  Okay, so this Touré guy is on The Cycle.  In order to jumpstart the predictable kneejerk, useless reactions of “conservatives,” Touré throws this bomb out there that Mitt Romney, the GOP nominee at the time, had begun the N-ization of the campaign.  Figure it out for yourselves.  Of course, [mocking] “I’ve never heard anything so outrageous.  You’re trying to turn everything into racism.”  This got your usual suspect conservative all up in arms.  They were blogging, screaming, YouTubing, on television, on radio.  [mocking] “This will be the thing that turns this campaign, these idiots, these libs.  They just keep doing these things.  This double standard and this hypocrisy, this is going to bring Obama down.  This is why liberals suck.”

This Day In Founding Fathers History – 6 June 2013

One notable birthday on this day in 1755, that of Nathan Hale. Hale was born in Connecticut and famously died at the age of 21 when he was hanged as a spy by General William Howe. Hale was among the top of his graduating class and he continued on to become a teacher. He considered the higher education of women to be a neglected issue and therefore taught women as well as men during his time as a teacher. After the Battle of Lexington, Hale enrolled in the militia of his town. Hale was one of the first in his town to publicly show his support of independence and taking to arms in order to secure it. Hale was part of a group known as Knowlton’s Rangers, a special corps led by Colonel Knowlton. Washington pleaded to Knowlton for a volunteer to covertly gather intelligence from the British. At first no one was willing to put his life on the line for this, but, despite pleadings from close acquaintances not to do so, Hale volunteered for the job. Hale carried on his person intelligence he had gathered, and when he slipped up and was caught by the British, this was the evidence used to convict him without trial. He was ordered to be hanged the next morning. He was hung upon an apple tree in Rutgers’s orchard, uttering first those famous last words, “I only regret that I have but one life to lose for my country.” ₁

Another birthday on this day in 1756, that of John Trumbull. Trumbull was an American artist known for his portraits and paintings of the American Revolution. Trumbull was born in Connecticut, graduated from Harvard, and served in the Connecticut militia. In 1777 he began his painting career, studying with Benjamin West in England. His first history painting was The Death of General Warren at the Battle of Bunker’s Hill, after which he began painting The Declaration of Independence while visiting Jefferson in Paris. He continuously worked on portraits of prominent figures of the Revolutionary period. Trumbull served as a secretary with the Jay Treaty Commission after being offered the job by John Jay, afterwards returning to his art. In 1817 he was commissioned to create four large history paintings for the rotunda of the U.S. Capitol in DC and was also elected president of the American Academy of the Fine Arts. ₂

Mike:  “Lawmakers demand crackdown on sex assault in military,” posted in the Washington Compost by Craig Whitlock.  I’m reading this last night and the thought is occurring to me as I am reading the female members of the United States Senate losing their collective cookies over, [mocking] “These nonstop sexual abuses in the Army, you’ve got to get this under control.”  As I’m reading the text of the conversation that goes on between one of the generals and one of the members of the Senate panel, and the mighty and loud protestations about the sexual assault conduct of the many members of this man’s army, how this has to end, we need policies and programs to deal with this, I’m just thinking this is an army.  This is an army!  This is not supposed to be a social laboratory.  This is an army.  It blows things up and it kills people.  We want it to do a lot less of that but that’s what it does.  It goes into foreign lands and finds the enemy and it kills them.  It finds where the enemy’s buildings are and it blows them to smithereens.  It finds where the enemy ships are and it sinks them.  It doesn’t solve the world’s sexual problems.  It doesn’t solve gender inequality.  It doesn’t solve the pay gap.  It doesn’t fix the freaking glass ceiling.  It’s an army!

But we’ve reached the vainglorious stage in our evolution where not only can our army blow things up and kill people, but we can equalize things between the two sexes across the entire globe.  You just wait and see, we’re going to have all kinds of initiatives and policies and programs and agencies and agents.  We’re gonna do this.  We’re gonna have men and women fighting wars side by side, competing to blow things up and kill people, and they’re all going to love one another and respect one another.  None of them are going to harass or assault one another either.  You understand me, general?  Really, seriously?  That’s what this has now come to?

The military chiefs acknowledged that they had neglected the spread of sexual abuse in the ranks.

Mike:  That is paramount to common defense.  Defending female nether regions is now also part of our common defense.  You can forgive the military leaders for not owning up to this, can’t you?

They said they were amenable to legislative changes that would take tougher action against sex offenders and provide more support to victims.

Mike:  Yes, now the victim culture makes its way inside the Army.  Oh, genius.  Oh, great muse, where have you been our whole lives?  Let’s have a Department of Victimology.  Who is the Joint Chief of Victimhood this year?  Who’s Obama going to nominate to be Joint Chief of Victimhood?

But they drew the line at one bill, co-sponsored by a fifth of the Senate, that would strip commanders of the legal power to oversee major criminal cases and transfer that authority to uniformed prosecutors. Such a change, they argued, would undermine the foundation of military culture by questioning the judgment of unit commanders.

“Without equivocation, I believe maintaining the central role of the commander in our military justice system is absolutely critical,” said Gen. Ray Odierno, the Army’s chief of staff. “Removing commanders, making commanders less responsible, less accountable, will not work. It will hamper the delivery of justice to the people we most want to help.”

DiLorenzo has a piece out at LewRockwell.com today.  It’s called “The Real Lincoln in His Own Words.”  If you’re a Lincoln lover, you need to read this.  If you’re not a Lincoln lover, you really need to read this.  DiLorenzo goes into that Lincoln was the great equalizer, the great emancipator, the great promoter of diversity and equality and all that stuff.  Really?  What history book did you read that in?  DiLorenzo cites a new book that’s out there called Lincoln Uncensored.  It’s written by a guy named Joseph Fallon.  Here he’s referring to Lincoln viewed as the great emancipator, great equalizer, great racially-diverse, racially-sensitive president that did all these magnanimous things selflessly to begin the process of equality among the races.

This view of Lincoln, writes Fallon, is only true "in official histories or in Hollywood movies" but not in reality. The reason for this historical disconnect is that "this myth of Lincoln, not the Constitution . . . now confers legitimacy on the political system of the United States." [Mike: That is exactly the point that I make in What Lincoln Killed: Episode I.] Despite being mostly a bundle of lies, it is nevertheless the ideological cornerstone of statism in America and has been for nearly 150 years.

This Day In Founding Fathers History – 5 June 2013

On this day in 1851, Harriet Beecher Stowe’s Uncle Tom’s Cabin; or, Life Among the Lowly began running as a serial in the Washington Era, a weekly abolitionist publication. The readership of the publication was not large; however as Stowe’s story was published, it garnered increasing attention. In March of the following year, a Boston publisher issued Uncle Tom’s Cabin as a book. It immediately became a best seller, with 3,000 copies sold the first year and almost 2 million copies worldwide by 1857. The issue of slavery was brought to the mainstream of discussion and debate in America. ₁

In 1805 on this day, a tornado in southern Illinois was the first recorded tornado in “Tornado Alley.” The area had a very low population density at the time, although farms and river boats were destroyed. The tornado began in southeast Missouri, crossed the Mississippi River, and hit the American Bottom area of Illinois. ₂

On this day in 1794, Congress passed the Neutrality Act of 1794. The act was to be in effect for two years, to be continued at the discretion of subsequent Congresses. The act was designed to prevent offenses against neutrality, especially on the high seas. Any party with a complaint could bring it before a U.S. District Court. Any parties within the U.S. who advanced hostilities against a neutral state, meaning any country or state with whom the U.S. is at peace, would face a charge of high misdemeanor and be fined and/or imprisoned. ₃
