In researching the GOP Senate’s unprecedented action of writing to unnamed Iranian diplomats I came across a resolution passed by Joint Resolution of Congress in 1896 to regulate the importation of alien friends for the Tennessee World’s Fair. Note the nod given to the Tennessee Exposition Company which was chartered in TN NOT Mordor. Also note the reference to the 1885 act regarding alien labor and the specificity of citing “The Chinese”! I will further explore the 1885 act but in the meantime, this resolution, which is NOT a legislative act but instead an explanatory statement on a previous act is good reading for the [r]epublican.

“Resolved by the Senate and House of Representatives of  the United States of America in Congress assembled. That the Art of Congress approved February twenty sixth, eighteen hundred and eighty-five, prohibiting the importation of foreigners under contract to perform labor and the Acts of Congress prohibiting the coming of Chinese persons into the United States, and the Aets amendatory of these Acts. shalt not be construed. nor shall anything therein operate to prevent, hinder, or in anywise restrict any foreign exhibitor, representative, or citizen of a foreign nation, or the holder who is a citizen of a foreign nation, of any concession or privilege from the Tennessee Centennial Exposition Company of Nashville. TN, from bringing into the Uhited States under contract, such mechanic, artisans, agents, or other employees, natives of their respective foreign countries as they or any of them, may deem necessary for the purpose of making preparations for conducting their exhibits or of preparing for installing or conducting any business; authorized or permitted under or by virtue of or pertaining to any concession or privilege which may have been granted by the Tennessee Centennial Exposition Company of Nashville, Tennessee, in connection with such exposition: however, That no alien shall by virtue of this Act enter the United States under contract to perform labor except by express permission, naming such alien of the Secretary of the Treasury; and any such alien who may remain in the United States for more than one year, after the close of said exposition. Shall thereafter be subject to all the processes and penalties applicable to aliens coming in violation of the alien-coutract-labor law aforesaid.”

Reagan-Berlin seriousRemember President Obama’s rambling veto of the Keystone Pipeline bill which never mentioned the Constitution? Remember James Madison’s veto of the Bonus Bill that mentioned and made the bedrock of his veto dozens of times? In 1982, President Reagan vetoed 78 bills sent to him by Congress, read the list of bills and you will note these are now included in “CR’s” and not even presented for approval. Download and read the pdf of the veto list

An_Act_Respecting_Quarantines_and_Health_LawsWhat did the Federalist-Founding Generation do when they had to deal with the fight against disease, quarantine and health laws? They stepped aside and let the States handle it as they should. This nifty little find at archive.gov shows Congress acting constitutionally (for a change) on the subject

The COMPLETE statement made by the NC Ratifying Convention that refused to ratify the Constitution unless Amendments were added. This statement demolishes two arguments. 1. That the States were not countries as today’s France is and 2. That they were but agents of the Articles of Confederation, subjected to IT’S rule and not their own, to wit.

“In Convention of the people of the state of South Carolina, by their representatives, held in the city of Charleston, on Monday the 12th day of May, and continued by divers adjournments to Friday, the 23d day of May, Anno Domini 1788, and in the 12th year of the independence of the United States of America.

The Convention, having maturely considered the Constitution, or form of government, reported to Congress by the Convention of Delegates from the United States of America, and submitted to them by a resolution of the legislature of this state, passed the 17th and 18th days of February last, in order to form a more perfect union, establish justice, insure domestic tranquility, provide for the common defence, promote the general welfare, and secure the blessings of liberty to the people of the said United States, and their posterity, — Do, in the name and behalf of the people of this state, herby assent to and ratify the said Constitution.”

Citizens_Guide_to_impeachmentWhile searching for reading material on Obama’s future-an impeachment-I ran across this wonderful essay, written in 1974 “The Citizens Guide To Impeachment”. This piece traces the entire and complete history of the Constitution’s impeachment clause, how it was dewscribed during ratification and how early Congresses, pack with the Constitution’s Framers, understood the clause. You WON’T find this anywhere else, read and enjoiy the learning experience.

VA delegate to the Federal Convention of 1787 warned the other delegates of their “yea” votes on the Constitution before it left the convention. Mason’s predictions of doom have all come to pass but we seem to have grown accustomed to them so they seem normal, not ominous. Read this full objection to be cleaned of that jingoism.

The 1860 Republican Party Platform reads like it came right from the pen of Thomas Jefferson:

“[plank] 4. That the maintenance inviolate of the rights of the states, and especially the right of each state to order and control its own domestic institutions according to its own judgment exclusively, is essential to that balance of powers on which the perfection and endurance of our political fabric depends; and we denounce the lawless invasion by armed force of the soil of any state or territory, no matter under what pretext, as among the gravest of crimes.
5. That the present Democratic Administration has far exceeded our worst apprehensions, in its measureless subserviency to the exactions of a sectional interest, as especially evinced in its desperate exertions to force the infamous Lecompton Constitution upon the protesting people of Kansas; in construing the personal relations between master and servant to involve an unqualified property in persons; in its attempted enforcement everywhere, on land and sea, through the intervention of Congress and of the Federal Courts of the extreme pretensions of a purely local interest; and in its general and unvarying abuse of the power intrusted to it by a confiding people.
6. That the people justly view with alarm the reckless extravagance which pervades every department of the Federal Government; that a return to rigid economy and accountability is indispensable to arrest the systematic plunder of the public treasury by favored partisans; while the recent startling developments of frauds and corruptions at the Federal metropolis, show that an entire change of administration is imperatively demanded.”

By the end of Lincoln’s political lobotomy and 15 years of unlimited, tyrannical power, those same Republicans had a 180 degree change of heart, vilifying private schools. Demonizing the Democrat Party and threatening it with extinction while denying the Souther States had any right to self-government by simultaneously decreeing Southern inferiority.

7. The public school system of the several states is the bulwark of the American republic; and, with a view to its security and permanence, we recommend an amendment to the constitution of the United States, forbidding the application of any public funds or property for the benefit of any school or institution under sectarian control.
8. The revenue necessary for current expenditures and the obligations of the public debt must be largely derived from duties upon importations, which, so far as possible, should be so adjusted as to promote the interests of American labor and advance the prosperity of the whole country.
16. We charge the Democratic party with being the same in character and spirit as when it sympathized with treason; with making its control of the house of representatives the triumph and opportunity of the nation’s recent foes; with reasserting and applauding in the national capitol the sentiments of unrepentant rebellion; with sending Union soldiers to the rear, and promoting Confederate soldiers to the front; with deliberately proposing to repudiate the plighted faith of the government; with being equally false and imbecile upon the over-shadowing financial question; with thwarting the ends of justice, by its partisan mismanagements and obstruction of investigation; with proving itself, through the period of its ascendency in the lower house of congress, utterly incompetent to administer the government; and we warn the country against trusting a party thus alike unworthy, recreant, and incapable.

The ACTUAL debate page from Congress over Barbary War powers, 1801

DeceptiCONS will never be your friends again when talking Presidential war powers. This image is a scan of the actual debate in Congress of Dec, 1801, over whether or not President Jefferson possessed unilateral war making powers or if Congress did (against the Barbary Pirates). Congress determined that THEY had those powers but could authorize the President to act on them AFTER they acted. And for the BIG surprise, this Congress even passed a port tax to fund the construction of the naval vessels needed for the mission!

And if THAT’s not enough, please feast your hungry eyes on the Constitutional scholar, Tom Woods refers to on this subject, Louis Fisher. Fisher’s report on “Presidential War Powers” is the ultimate smackdown to war-mongering Hillarys McCains and DeceptiCONS in general.

This 1886 SCOTUS decision is well worth reading and studying as we try an build legal cases for the States to re-assert control over the importation of “alien friends” into their populations. I have excerpted the pertinent passage for you, read the entire decision here. ”

“Is the law under consideration void as a regulation of commerce? Undoubtedly it is, in some sense, a regulation of commerce. It arrests a vessel on a voyage which may have been a long one. It may affect commerce among the states when the vessel is coming from some other state of the Union than Louisiana, and it may affect commerce with foreign nations when the vessel arrested comes from a foreign port. This interruption of the voyage may be for days or for weeks. It extends to the vessel, the cargo, the officers and seamen, and the passengers. In so far as it provides a rule by which this power is exercised, it cannot be denied that it regulates commerce. We do not think it necessary to enter into the inquiry whether, notwithstanding this, it is to be classed among those police powers which were retained by the states as exclusively their own, and therefore not ceded to congress; for while it may be a police power in the sense that all provisions for the health, comfort, and security of the citizens are police regulations, and an exercise of the police power, it has been said more than once in this court that, even where such powers are so exercised as to come within the domain of federal authority as defined by the constitution, the latter must prevail.

But it may be conceded that whenever congress shall undertake to provide for the commercial cities of the United States a general system of quarantine, or shall confide the execution of the details of such a system to a national board of health, or to local boards, as may be found expedient, all state laws on the subject will be abrogated, at least so far as the two are inconsistent; but until this is done, the laws of the state on the subject are valid.”

Prof Randy Barnett explores whether the Militia, in the second Amendment sense, was ever intended to exist with or without “arms” as a universal right. A question easily answered, I think by simply asserting that prior to Amendments, there was no mention of a “right to bear arms” nor a prohibition, thus the Framer’s “if a power is not enumerated TO Congress (in Art I, Sec 8) then it is RESERVED”

James Madison’s “Report of 1799-To The Virginia Assembly” This document lays out the proper division of powers when it comes to “immigration” and as I have told you, leaves no doubt that Congress was never granted power over alien “friends”

NEW – If you wonder why I refuse to deviate from the opposition to our bellicose foreign policy and all that it conjures up, read this most important essay about the effects of “War, Power and Supremacy” Here’s an excerpt. “Except for the inhabitants of certain former states of the Confederacy, particu- larly Virginia, Tennessee, and Georgia, Americans have no experience at the other end of the process of radicalization. They have not suffered the fate of having been demonized, followed by savage in- vasion where no quarter is given, commu- nities laid waste—and that succeeded by a period of occupation replete with the usual antics of unscrupulous exploita- tion and further brutalizing acts. Lacking such a historical memory, finding it easy to dismiss the Southern experience, and, furthermore, being inclined by nature and education to discount history in general, Americans lack both the internalized ex- perience of the vanquished and the incli- nation to suspect a political establish- ment that promotes such barbarism as a new principle of global supremacy.

Ok, so I’m a little late to the table here, but Wow! Mike, you and your people are a veritable cornucopia of the truth. The 1860 Republican Party Platform is an excruciating reminder of the sad state of affairs we ‘exist’ under today.

mvanvleck

Mike, I’m a longtime listener and fan and appreciate your ability to help me think critically about our government and current events. I’d like to comment on your opinion as it relates to the gold standard. I share your concerns about our debt-based currency and believe that gold is ultimately the only thing that is capable of holding our free-spending government in check. The traditional gold standard has significant limitations with respect to situations where the money supply needs to expand or contract however. In the past, governments have arbitrarily set their currency to a certain value of gold….and then arbitrarily changed this value when they overspent and needed to devalue the currency.
A new system based on gold will therefore need to free gold from it’s ties to government. A nation’s currency will have to stand on its own (supported by a thriving manufacturing and export business or undermined by perpetual trade deficits). How successful a nation is in this endeavor will be continuously and immediately reflected by that currency’s value relative to Freegold. Physical gold (not paper gold) will be valued by the free market and people who wish to save their productive earnings for the future will save in gold. Saving in dollars (or other local currency) will continue to be a risk if their government is unable to live within its means. (How many Indians would you estimate save their long-term wealth in Rupee’s?).
The IMF dollar system is based on debt and its life is nearing its end. We can see this by the central banks’ concerted efforts to perpetuate exponential debt with QE and negative interest rates! They are desperate to keep the dollar system alive! I cannot begin to do justice to the economics and history supporting the evolution of our system to its logical successor, but I have studied and learned from Another, Friend of Another, and Friend of Friend of Another (FOFOA) at FOFOA.blogspot.com.
FOFOA has truly dedicated himself to helping those who understand something is wrong with our current fiat system to make sense of where we are logically headed when this system fails.
I would love to talk with you sometime about this, because I think you would appreciate hearing his thoughts and discussing the ideas that make the basis for where our system is headed.
I am a father of four and believe that the idea that is America can only be saved by dedicated individuals that are willing to learn and work to preserve the ideas of our founding. Our currency is the backbone of our society, and you are right to suggest that gold’s future roll needs to be absolutely central. FOFOA has intelligently presented a system that the people of the world can accept….because it will be fair and will simultaneously limit the power of governments!
Respectfully,
Mat
