Mike:  Remember earlier I told you I’d been corresponding with Judge Brennan over an Article V convention and his amendments to the Constitution.  Judge Brennan has an amendment to the Constitution that would prevent the president from doing exactly what we just talked about and what Rand was talking about.  I wrote back to Judge Brennan.  I’m going to hand this to Captain Pickard so we can make this a post at MikeChurch.com.  I responded back to Judge Brennan.  I said: Your amendment is great but it doesn’t go far enough.  Here’s what I wrote:

Dear Judge Brennan –

Your amendment is long overdue yet truly sad that it is needed in a written form, seeing as how the president has no Article II power to terminate anyone save for those lost in a congressionally-authorized military action.  I believe, however, that men being the eternal despot in waiting most are, your verbiage is not strong enough.  Please see my edit.

[Mike: This is my edit combined with Judge Brennan’s amendment.] Except in the prosecution of a war duly declared by the Congress, the president shall not order nor authorize the killing of any human being without the prior advise and consent of the United States Senate and a concurrence of three-quarters of the members therein by voice or other recorded vote as they shall determine, while in session, a quorum having been certified therein, nor shall any citizen of the United States be deprived of life without due process of law, the previous articles and amendments to this Constitution notwithstanding.

Sidebar_ad_Secede_die_baseball_capMike:  That’s a heck of an amendment.  That eliminates what we’re talking about.  It eliminates any scintilla of a doubt as to whether or not the president has the power and puts the power, if indeed it is ever to be exercised, in the hands of the deliberative body known as the United States Senate.  They have to get three-quarters of the members by voice vote to affirm.  That is not going to happen on very many occasions.  This will eliminate and pretty much wipe out what it is that we’re talking about here, and return it to an instance so rare that men are willing to sign their own names to the death warrant.  You want the power to kill in the U.S. Senate, Senator Graham, so desperately?  You want the power to kill a citizen?  [mocking] “I never said that, Mr. Church.”  I didn’t say you did.  I didn’t hear mighty protestations against the president’s claim of authority here.

You want that?  Fine, we’ll put it to a vote.  John Smith is scheduled to be terminated by a predator drone.  He must therefore receive three-quarters of a vote in this body, the U.S. Senate.  Notice we didn’t leave this in the House.  This is in the Senate.  You must therefore receive three-quarters of a majority of the quorum present.  Are you going to be in that number, Mr. Vitter?  Are you going to be in that number, Mr. McCain?  Are you going to sign your name to that death warrant?  Are you certain that that is a just exercise of legislative power to the United States Senate, to execute a citizen without due process?  Are you sure about this?  Here, you’re going to have to do it by voice vote or recorded vote.  Your name is going to be on that warrant.  Your name is going to issue when that happens.  Folks, that’s accountability.  If you want to stop this, amend the Constitution once and for all and take it out of the hands of people that you fear are about to execute this power.  That’s what I say.
